Comments:
An unannounced monitoring inspection was conducted on November 6, 2023, from 9:15am-10:30am. At the time of entrance, ( 8 ) children ( 30 ) points were in care with (2 ) caregivers present. The inspector reviewed 5 children?s records and 2 caregiver/household member records. Children were observed sleeping in their cribs and 1 child was sitting on the couch with a book. Consultation was given to the provider again about infants sleeping in the cribs with stuffed toys, pillows and comforters. A high risk violation was cited again. The Inspector stressed the importance of compliance with the infant crib standards for the protection of the infants in care. No medications were on site. Areas of non-compliance are identified on the violation notice. Repeat violations were found and are identified within this report.

Description: Based on observation and provider interview, the current violation notice and inspection summary was not posted in a conspicuous place on the licensed premises.
Evidence: The current violation notice and inspection summary was not posted within the Family Day Home.

Plan of Correction: The provider will post the current violation notice and inspection summary.

Standard #: 8VAC20-800-800-B
Description: Based on a review of records, the provider has not reviewed and updated the emergency preparedness plan annually.
Evidence: The emergency preparedness plan, dated 6/3/2022 was inspected. There is not documentation that the plan has been reviewed and updated annually.

Plan of Correction: The provider will review and update the emergency preparedness plan.

Standard #: 8VAC20-800-830-C
Description: (REPEAT VIOLATION)
Based on provider interview, documentation is not maintained of emergency evacuation and shelter in place drills.
Evidence: The provider could not find the emergency evacuation and shelter in place drills. The provider stated, "I don't do the fire drills because I have infants, my assistant and I can't take them outside".

Plan of Correction: Monthly fire drills and 6 month shelter in place drills will be practiced and recorded on the fire drill form. This form will be maintained monthly and provided at the next inspection.

Description: Based on provider's comment, a written report was not completed and submitted to the department within 5 working days of the date when a child sustained a serious injury .
Evidence: The provider reported that on 7/27/2023 she performed first aid and CPR for child # 8, 2 years old. The provider said the child was eating something the parent brought from home and proceeded to choke. The provider said she scooped the food out of her mouth, realizing the child was not breathing she called 911 and started CPR.

Plan of Correction: The provider will go online to DOE and file the injury report.

Description: Based on observation, children were allowed to eat while walking around the daycare.
Evidence: Child # 8 who is 2 years old was observed walking around the living room while eating a cookie.

Plan of Correction: The provider will have all children sitting at a table or high chair when eating and drinking.

Standard #: 8VAC20-800-60-B
Description: (SYSTEMIC DEFICIENCY)
Based on a review of 5 children records, 2 children records did not have documentation of medical policy numbers and 1 child's record did not have 2 emergency contact name, address and phone number and authorization for emergency care.
Evidence: Child # 2, date of first attendance 8/1/2023 was missing the medical policy number.
Child # 4, date of first attendance 11/6/2023 was missing the medical policy number, 1 emergency contact name, address and phone number and authorization for emergency care.

Plan of Correction: Parents will provide the required information for the child's record.

Description: (REPEAT VIOLATION, SYSTEMIC DEFICIENCY)
Based on a review of 5 children records , 5 of the records did not have documentation that parents have been provided policies for the administration of medications before the child's first day of attendance.
Evidence: The following children records did not have the second signature page for policies for the administration of medication in the child's file.

Standard #: 8VAC20-800-340-C
Description: Based on observation the bathroom does not have paper towels.
Evidence: The bathroom that children use did not have paper towels accessible to the children in care.

Plan of Correction: Paper towels will be placed in the bathroom.

Standard #: 8VAC20-800-500-C
Description: Based on observation, the stationary outdoor playground equipment is not placed at least 6 feet from the perimeter of other play structure or obstacle.
Evidence: The slide was found within 3 feet of the side of the house and 2 feet from the Fisher Price picnic table and playhouse.

Plan of Correction: The slide will be positioned so it is 6 feet away from any other structure or house. If this can not be done then the children will not use the slide.

Standard #: 8VAC20-800-530-F
Description: (REPEAT VIOLATION, SYSTEMIC DEFICIENCY)
Based on observation and provider interview, pillows, stuffed toys, and comforters were found in the crib with sleeping infants.
Evidence: The Inspector arrived at 9:15 am to find 7 infants asleep in their cribs. Every crib had a pillow, stuffed toy or comforter found around the sleeping infants.
A pillow was found in the crib with infant #1,
Rolled blankets and a stuffed toy was found in the crib with infant #2,
A stuffed toy and blanket was found in the crib with infant #3,
A heavy comforter was found covering the top of the crib where infant #4 was asleep,
A filled comforter was in the crib with infant #6 and
A pillow and stuffed toy was in the crib with infant #7.

Plan of Correction: The provider immediately removed all the items from the cribs. The provider will not put anything inside the cribs where infants are sleeping.
