22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced renewal inspection was conducted on June 4, 2024 from approximately 11:10 am to 2:00 pm. Sixteen staff were present supervising seventy-five children ranging in age from infants through school age. Additional staff were on site for administrative and kitchen duties. Children were observed during circle time, lunch and naptime. Licensing Inspector reviewed standards related to administration, staffing/supervision, nutrition, diapering, medication, emergency drill documentation, inspection reports and required postings. Seven staff and six child records were reviewed. Violations found are noted on the violation notice.

Violations:
Standard #: 8VAC20-780-40-M
Description: Based on observation and interview, facility did not ensure there is a current written list of all children's allergies, sensitivities and dietary restrictions in each room where children are present. The list is to be dated.

Evidence: In the toddler classroom, staff reported child #5 (present in the room) had a food allergy. The allergy was not noted on the allergy list in the room. The allergy list was not dated.

Description: Based on observation, facility did not ensure when pillows are used they are covered with pillow cases.

Evidence: In the rear 2's classroom, a child was observed napping on a square brown pillow and it was not covered with a pillow case.

Evidence: In the young infant classroom, the diapering pad had two 1" tears in the cover causing the surface to be absorbent.

Description: Based on observation, facility did not ensure toilet chairs are emptied promptly and cleaned and sanitized after each use.

Evidence: In the girls restroom, a child's toilet chair was observed in the sink area with a discolored yellow substance in the bowl.

Description: Based on observation and interview, facility did not ensure tables and high chairs are sanitized before and after each use for feeding.

Evidence: In the 2's classroom, staff was observed spraying the tables with soap and water after children finished eating lunch. Staff reported she sprays tables with bleach/water at the end of each day.

Description: Based on observation and interview, facility did not ensure prepared infant bottles are labeled with the child's name and date.

Evidence: In the young infant room, four bottles were observed in the refrigerator that were not labeled with the child's name and date.
