Background check requirements - effective July 1, 2024 reviewed ( June 7, 2024 memo)

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was initiated on 06/10/2024 at 12:20 pm and completed on 06/10/2024 at 4:00 pm.

At the time of the tour there were 77 children present ,ages 2 years - 5 years, with 8 staff. Ratios were reviewed during nap.

Records were reviewed for 4 staff and 5 children. Medication, emergency supplies and a sample of 10 injury reports reviewed. The inspector additionally reviewed the outdoor play area and physical plant.

Based on the information gathered a violation of applicable law were found. The violation is listed on the violation notice issued to the facility and was reviewed with administrative staff at the conclusion of the inspection.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of a criminal history record information check from any state in which the individual has resided in the preceding five years.

Evidence:
1. Staff 1, hire date 08/28/2023, lacks the results of a criminal history record check from another state she has resided in within the past five years.
a. Staff 1 indicated on her sworn statement or affirmation she had resided in another state, other than Virginia, within the past five years.
2. Administrative staff confirmed that an out-of-state criminal record check was not on file for staff 1.

Plan of Correction: Administrative staff stated that they thought a criminal record check had been requested for staff 1 - from this state.
The central registry check was obtained and is on file.
As the criminal record check results could not be located a new check was requested on the day of the inspection.
