22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was conducted on 5/20/24. The on-site inspection was conducted from 12:45 pm to 1:50 pm. The inspector reviewed compliance in the areas listed above. There were 5 children present with one caregiver. The inspector reviewed 5 children?s records, 1 caregiver record and 2 household member's records. This inspection included document review, tour of the facility, interviews and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-830-A
Description: Emergency evacuation procedures shall be practiced monthly.
There were no emergency evacuation procedures practiced for October 2023 to April 2024.

Plan of Correction: I will conduct monthly escape drills.

Standard #: 8VAC20-800-830-B
Description: Shelter-in-place procedures shall be practiced a minimum of twice per year.
There were no shelter-in-place practiced procedures for 2023.

Plan of Correction: I will do 2 shelter in place drills for 2024.

Standard #: 8VAC20-800-920
Description: A menu for the current one-week period shall be dated, given to parents or in an accessible area.
There was no menu for the current one-week period.

Plan of Correction: I will do a menu.

Standard #: 8VAC20-800-100-A
Description: A physical is required for each child within 30 days after the first day of attendance.
There was no physical on file for Child A, 4 months after the child enrolled.

Standard #: 8VAC20-800-50-A
Description: A written record of children in attendance each day shall be maintained.
There was no attendance maintained on 5/20/24, there were 5 daycare children present.

Plan of Correction: I will do the attendance today.

Description: A child's record shall contain insurance policy number at the time of enrollment.
Child A enrolled 4 months prior and there was no insurance policy number on file.

Plan of Correction: I will get that information.

Description: Current certification in first aid and CPR are required.
Caregiver A's First Aid and CPR certification expired over 4 months ago.

Plan of Correction: I will obtain up to date First Aid and CPR.

Description: Each caregiver and adult household member shall have a current Tuberculosis test/screening every two years from the date of the first Tuberculosis test/screening.
Caregiver A's tuberculosis test expired 6 months ago.

Plan of Correction: I will obtain a new tuberculosis test/screening.

Standard #: 8VAC20-800-500-C
Description: Stationary equipment outside shall not be installed over concrete or any other hard surface.
A rocker and slide were located over concrete.

Plan of Correction: I mov ed the equipment during the inspection.
