Comments:
On 01/11/2024 from 12:30 to 1:30 and 01/25/2024 12:30 to 1:30 an unannounced inspection was conducted in response to a self-reported incident received on 12/14/2023. Interviews were conducted regarding the incident and records and policies and procedures were reviewed. The information gathered during the inspection resulted in violations. Areas of non-compliance are identified on this Violation Notice.

Violations:
Standard #: 8VAC20-780-170-A
Description: Based on interviews, when there was evidence that the safety of children may be jeopardized by contact with a staff member because of the physical health of such staff member, the licensee failed to, at a minimum, prohibit the employee from engaging in contact with the children until a physician confirms that any risk has been eliminated or can be reduced to an acceptable level by reasonable accommodations.
Evidence:
1. Interviews revealed the following: staff 1 has physical limitations treated by a physician every 6 months; at least two staff members feel staff 1 should not be working alone with children; staff 1 had been observed to ask a child to assist her to get out of a chair; on 12/14/2023, staff 1 was unable to catch a three year old child in her care who ran out of the center to the main road and toward an intersection; once a bystander caught the child, staff 1 was unable to accompany the child back to the center and the bystander had to go to the center to request assistance.
2. As of 1/25/2024, there was no evidence that the licensee had prohibited the employee from engaging in contact with the children until a physician confirms that any risk has been eliminated or can be reduced to an acceptable level by reasonable accommodations.

Standard #: 8VAC20-780-270-A
Description: Based on observation, the center failed to ensure areas and equipment of the center, inside and outside, were maintained in a safe and operable condition.
Evidence:
On 1/25/2024 upon entering the center at the single door by the offices the door was closed but the LI was able to pull the door open without turning the doorknob, as the latch mechanism was not operable. When leaving the door was once again closed but not latched and the LI was able push the door open without turning the doorknob.

Standard #: 8VAC20-780-340-A
Description: Based on interviews, the center failed to ensure staff supervising children always provide care, protection, and guidance.
Evidence:
Per interviews with Staff 1 and Staff 2: On 12/14/2023 child 1, age 3, remained in the front office with Staff 1, as child 1 was upset after being dropped off late; Child 1 ran out the door to the center; Staff 1 followed behind child 1 to the main road toward the intersection but could not keep up with child 1 due to physical limitations; A bystander stopped to help catch the child; Staff 1 could not get child 1 back to the center, so the bystander went to the center to get help; Staff 2 arrived with a car and a car seat to pick them up.
