63.2 CHILD ABUSE AND NEGLECT

Comments:
An unannounced non-mandated monitoring inspection was conducted on 02/09/2023. There were 10 non-resident children and 1 resident child, ages 5 weeks-2 years, totaling 27 points, one substitute provider, and one assistant caregiver present during the inspection. The inspector reviewed compliance in the areas of administration, personnel, physical equipment and environment, care of children, preventing the spread of disease, and nutrition. A total of five children?s records were reviewed. The children were observed during free choice play and having breakfast. The inspector reminded that the provider, via a video call that took place during the inspection, of the upcoming Family Day Home Phase Training that is scheduled for February 14, 2023. The inspector arrived for the inspection at 9:05 am and departed at 10:30 am.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 8VAC20-800-900-B
Description: REPEAT VIOLATION

Based on observation, the provider failed to ensure that children shall not be allowed to eat or drink while walking, running, playing, lying down, or riding in vehicles.

Evidence: Child 3 was observed walking around the child care room while eating a French Toast Stick.

Plan of Correction: Children will sit while they eat.

Standard #: 8VAC20-800-100-A
Description: REPEAT VIOLATION

Based on record review, the provider failed to ensure that prior to a child?s attendance or within 30 days after the first day of attendance, documentation of a physical examination by or under the direction of a physician shall be obtained.

Evidence: The record for Child 5 contained a documented start date of 07/08/2022; the record did not contain documentation of a physical examination.

Plan of Correction: The parents were contact, the information was requested and children cannot return until the information is provided.

Standard #: 8VAC20-800-60-B
Description: REPEAT VIOLATION
Based on record review, the provider failed to ensure that children?s records shall contain all of the elements as required by the standards.

Evidence:
1. The record for Child 1 did not contain the following information: name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached (there were no addresses provided for the two designated contacts).
2. The record for Child 4 did not contain the following information: name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached (there were no addresses provided for the two designated contacts); and information on allergies and intolerance to food, medication, or any other substances, and actions to take in an emergency situation.
3. The record for Child 5 did not contain the following information: the telephone number of the child?s physician.

Plan of Correction: Parents were contacted, the information was requested and children will not return until the information is provided.

Description: REPEAT VIOLATION

Based on record review, the provider failed to obtain documentation that the child has been adequately immunized.

Evidence: The record for Child 5 contained a documented start date of 07/08/2022; the record did not contain an immunization record.

Plan of Correction: The parents were contact, the information was requested and children cannot return until the information is provided.

Standard #: 8VAC20-800-140-D
Description: Based on interviews, the provider failed to ensure that a substitute provider shall record and sign the time of arrivals and departures on each day that the substitute provider works.

Evidence: Caregiver 1 was in the role of Substitute Provider on 02/09/2022. Caregiver 1 and Caregiver 3 both stated there was not a record of the substitute providers arrival and departure each day that they serve as the Substitute Provider.

Plan of Correction: The form has been printed and will be used.

Standard #: 8VAC20-800-680-B
Description: REPEAT VIOLATION

Based on observation, the provider failed to ensure that children?s hands are washed with liquid soap and warm running water after toileting or diapering.

Evidence: Caregiver 1 was observed during a diaper change. The caregiver did not ensure that the child?s hands were washed with liquid soap and warm running water after the diaper change.

Plan of Correction: Will wash hands after diapering.
