22.1 BACKGROUND CHECKS, CODE, CARBON MONOXIDE

Comments:
An unannounced monitoring inspection was conducted on 04/17/2023. The focus of the inspection was to determine whether the provider had corrected or is in the process of correcting previously cited violations in the areas of the standards or laws referenced above. Any non-compliant elements of standards or laws are documented on the Violation Notice of this inspection.

Pursuant to 8VAC20-820-410, General Procedures and Information for Licensure, the provider requested that the Department consider entering into a Consent Agreement in lieu of adverse action to deny the renewal application for a license. On April 4, 2023, the provider submitted a final Compliance Plan to address the standards and law documented on a Notice of Intent to Deny Renewal Application for a License issued, June 24, 2022. The areas identified below are actions on the final Compliance Plan that the provider failed to demonstrate that they accomplished.

The Compliance Plan stated that the provider would go through all of the paperwork in the children?s records to ensure that everything is filled out correctly and that this action would occur on a daily or as need basis. Findings during the inspection determined that the provider has not successfully obtained all of the required information for the children?s records.

Violations:
Standard #: 8VAC20-800-60-B
Description: REPEAT VIOLATION

Based on record review, the provider failed to ensure that children?s records shall contain all of the elements as required by the standards.

Evidence:
1. The record for Child 1 did not contain the following information: the name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached (there no designated contact persons listed); first date of attendance; and documentation of the review of the child?s emergency contact information.
2. The record for Child 2 did not contain the following information: name, address and telephone number of each custodial parent?s place of employment (a telephone number of the employer was not provided for the second custodial parent that was listed); and the first date of attendance.
3. The record for Child 3 did not contain the following information: name, address and telephone number of each custodial parent?s place of employment (the telephone numbers of the employers were not provided for either custodial parent); and documentation of the review of the child?s emergency contact information (an update has not taken place since enrollment; the documented first date of attendance in the record was 04/01/2021).
4. The record for Child 4 did not contain the following information: the first date of attendance; and documentation of the review of the child?s emergency contact information (the paperwork was originally signed on 11/23/2021).
5. The record for Child 5 did not contain the following information: name, address and telephone number of each custodial parent?s place of employment (the telephone numbers of the employers were not provided for either custodial parent); the first dated of attendance; and documentation of the review of the child?s emergency contact information (the paperwork was originally signed on 02/14/2022).

Plan of Correction: Will have all new forms completed by the parents.
