8VAC20-790 SUBSIDY REGULATIONS

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
A subsidy health and safety inspection (SHSI) was conducted on May 20, 2024 from approximately 3:00pm until 5:10pm. There were 67 children present with five staff supervising. A licensing inspection was also conducted on this date. Both inspections combined cover all subsidy health and safety regulations. Only subsidy requirements that are not covered in licensing standards were reviewed during this supplemental inspection.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice, sign, and return it to me within five business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the stand(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Description: Based on review of five staff records, the vendor did not ensure all staff who work directly with children obtained current certification in cardiopulmonary resuscitation (CPR) within 90 days of the date of employment.
Evidence:
1. The records for Staff #2 (Date of Employment 08/18/2023) and for Staff #3 (Date of Employment 09/26/2023) contained current CPR certification dated 01/20/2024.
2. Employees are required to complete CPR certification within the first 90 days of employment.
