Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements.

Comments:
An unannounced monitoring inspection was conducted on 5/30/24 from 9:40am to 12:20pm with the Director and Owner. There were 74 children in care, ranging in age from 10-months to 12-years-old, supervised by 12 staff. The children were observed playing with blocks, eating snack, singing songs, and coloring. Five child records and three new staff records were reviewed. The Center has 16 staff with current certification in CPR and First Aid, and 17 staff trained in Daily Health Observation. Ten medications and authorization forms were reviewed, and the center has 12 staff current in Medication Administration Training (MAT). Required postings were observed. The attendance, menu, allergy list, and emergency drill log were reviewed. The most recent Fire Inspection on file was dated 1/3/24 and the most recent Health Inspection on file was dated 12/19/23. Snack served was graham crackers, pineapple, and milk. Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by close of business on 6/12/24. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.

Violations:
Standard #: 8VAC20-780-140-A
Description: Based on review of five child records, the center did not obtain a physical examination for children within 30 days after the first day of attendance. Evidence: The physical on record for Child C, with a start date of 3/6/23, was dated 8/18/23. The physical on record for Child E, with a start date of 4/26/23, was dated 11/21/23.

Plan of Correction: In August 2023 the Owner of TLC took over the management of maintaining files, all files were thoroughly gone through and corrected. The owner and new Director will continue to ensure that all files are maintained according to licensing regulations. Physical forms will be turned in to TLC no later than 30 days after the start date of the child/children. If the parents don't return the proper documentation within the allotted amount of time the child/children will not be able to attend until done so, and proper documentation will be kept in the child/childrens folder. TLC is aware some documentation prior to August 2023 is incorrect and will continue to maintain appropriate files for the children in our care.

Standard #: 8VAC20-780-80-A
Description: REPEAT VIOLATION Based on observation and review of documentation, the center did not ensure that for each group of children, a written record of daily attendance was maintained that documented the arrival and departure of each child in care as it occurred. Evidence: At approximately 10:24am on 5/30/24, 14 children were observed in the PreK classroom. The attendance in the center?s app contained documentation of 13 children present. Staff reported that the 14th child had arrived at approximately 9:24am.

Plan of Correction: The 14th child in attendance in the classroom is an employee child who came in with the parent. All employees were informed that they must clock their child in before their shift starts. All TLC classrooms will be equipped with a tablet to ensure that accurate attendance records are kept and the front office will monitor attendance through procare and paper documentation.

Standard #: 8VAC20-780-280-B
Description: Based on observation, the center did not ensure that hazardous substances such as cleaning materials were kept in a locked place using a safe locking method that prevented access by children. Evidence: On 5/30/24 a container of disinfectant wipes was observed in a open bin next to the changing table in the toddler classroom.

Plan of Correction: Prior to licensing coming into the room the teacher changed a child and placed the container of sanitizing wipes in a bin next to the changing station. Each classroom has a cabinet with a lock in the classroom for the purpose of locking up all cleaning supplies out of reach of the children in our care.

Standard #: 8VAC20-780-500-A
Description: Based on observation, the center did not ensure that children?s hands were washed with soap and running water or disposable wipes before and after eating meals or snacks. Evidence: On 5/30/24 the two-year-old class was observed transitioning from playing with blocks to snack time without washing hands or using disposable wipes.

Plan of Correction: TLC ensures that all children in our care are using proper hand washing techniques, on the day of the inspection the children were just changed and had their hands washed. While waiting for snacks to be prepared the children played with some blocks. Will ensure that the children's hands are washed appropriately before meals. All classrooms are equipped with hand sanitizer and disposable cleaning wipes.

Standard #: 8VAC20-780-510-I
Description: Based on review of 10 medications and authorizations, the center did not obtain written authorization from a parent to administer a medication. Evidence: There was no written authorization from the parent of Child F to administer a nonprescription medication that was observed onsite on 5/30/24.

Plan of Correction: The medication form was again for an emergency medication for allergies. The form was filled out by the doctor and turned in by the parent. Was a school emergency action plan. Will ensure that all forms are completed and signed by the appropriate parties. Notified parent the day of the violation and sent home proper forms to be signed and returned by the parent and doctor.

Standard #: 8VAC20-780-510-P
Description: Based on review of 10 medications and authorizations, the center did not ensure that when an authorization for medication expired, that parents were notified that the medication needed to be picked up within 14 days or the parent must renew the authorization; and that medications that were not picked up by the parent within 14 days were disposed of by the center. Evidence: 1. The parent and doctor long-term authorization for an emergency medication for Child F expired on 8/12/23. The emergency medication was observed onsite on 5/30/24. 2. The parent long-term authorization for a second emergency medication for Child F expired on 3/21/24. The emergency medication was observed onsite on 5/30/24.

Plan of Correction: The medication was an emergency medication was not sent home, kept on-site until forms could be updated. Notified the parents and will keep proper documentation of said notifications in the child's file. Notified parent the day of the violation and sent home for new medication.

Standard #: 8VAC20-780-560-J
Description: Based on observation, the center did not ensure that tables were sanitized before and after each use for feeding. Evidence: On 5/30/24 the two-year-old class was observed transitioning from playing to snack and the tables were not sanitized before the children were served snack.

Plan of Correction: The teacher in the classroom cleaned the tables before licensing entered the classroom to observe while the children were finishing cleaning up for snacks. Each classroom in the facility has the appropriate cleaning and sanitizing supplies in their room locked away from children. We will continue to clean and sanitize properly.
