22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
A monitoring inspection was conducted today, April 17, 2023, as a follow-up to the issuance of a conditional license. The inspector was on site from approximately 10:15 am until 12:20 pm. The director was present and participated in the inspection. There were 31 children present, ranging in ages from three to five years, with five staff supervising. Upon the inspector?s arrival, children were building with different construction materials. The question of the day was ?can you build a building as tall as you??. Later children played a game of shape bingo, participated in a music and movement video and had time on the playground. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, and nutrition. A total of five child records were reviewed. Six staff records were reviewed on April 18, 2023, at the Warsaw administrative office. The inspector interacted with staff and children in care.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on review of six staff records, the center did not obtain results of the national fingerprint base criminal history background check prior to employment.

Evidence:

1. The record of staff #2, employed 11/01/2022, had an approved portability fingerprint check dated 11/22/2022, exceeding the employment date.
2. The record of staff #4, employed 11/01/2022, had an approved portability fingerprint check dated 11/10/2022, exceeding the employment date.
3. The record of staff #5, employed 11/01/2022, had an approved portability fingerprint check dated 11/10/2022, exceeding the employment date.

Plan of Correction: Per a member of management:: When we changed over to the new business entity on 11/01/2022, we hired all our staff from the previous business entity. We were under the impression that as long as staff were not working with children we had time to obtain all the new background checks. Going forward, awe have obtained all background check in the required timeframe for all new staff.

Description: Based on review of six staff records, the center did not obtain a completed sworn statement prior to the first day of employment for three staff members.

Evidence:

1. The record of staff #2, employed 11/01/2022, had documentation of a sworn statement dated 11/03/2022 exceeding the first day of employment.
2. The record of staff #4, employed 11/01/2022, had documentation of a sworn statement dated 11/03/2022 exceeding the first day of employment.
3. The record of staff #5, employed 11/01/2022, had documentation of a sworn statement dated 11/03/2022 exceeding the first day of employment.

Plan of Correction: Per a member of management:: When we changed over to the new business entity on 11/01/2022, we hired all our staff from the previous business entity. We were under the impression that as long as staff were not working with children we had time to obtain all the new background checks. Going forward, awe have obtained all background check in the required timeframe for all new staff.

Standard #: 8VAC20-770-60-C-2
Description: 60-C-2
Based on review of six staff records, the center did not obtain the results of a central registry background check within 30 days of employment for two staff members.

Evidence:

1. The record of staff #3, employed 03/06/2023, did not contain documentation of a central registry background check.
2. The record of staff #4, employed 11/01/2022, contained a central registry check dated 01/30/2023, exceeding 30 days from the date of employment.

Plan of Correction: Per a member of management:: When we changed over to the new business entity on 11/01/2022, we hired all our staff from the previous business entity. We were under the impression that as long as staff were not working with children we had time to obtain all the new background checks. Going forward, awe have obtained all background check in the required timeframe for all new staff.

Standard #: 8VAC20-780-240-A
Description: Based on review of six staff records, the center did not ensure one staff completed the Virginia Department of Education- sponsored orientation course within 90 calendar days of employment.

Evidence:

The record of staff #1, employed 11/01/2022, did not contain documentation of completion of the Virginia Department of Education orientation course exceeding 90 calendar days.

Plan of Correction: Per a member of management: I will ensure preservice training is completed.

Standard #: 8VAC20-780-270-A
Description: Based on observation, the center did not ensure all areas, inside and outside, were maintained in a clean, safe and operable condition.

Evidence:

1. The outdoor climbing equipment on the playground had visible rust on the platform and railing where the paint had peeled off or was worn off. Children were observed playing on the equipment during the inspection.
2. The bench to the drum set on the playground was broken in half exposing a jagged edge that could snag the skin of a child.

Plan of Correction: Per the staff: We will have children play in the play area next to the classroom until the playground equipment can be painted and repaired.
