Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
The licensing inspector conducted an unannounced renewal inspection on Tuesday, May 28, 2024, to determine the provider's compliance with licensing standards. The inspector was on site from10:10am to approximately 12:30pm. During the inspection, there were a total of 12 children in care, totaling 35 points, in the direct care of three caregivers. Upon arrival, the children were observed in their designated areas of the family day home. All areas used for childcare were inspected. The family day home has age and stage appropriate materials and supplies. The caregivers were observed having positive interactions with the children in care. The first aid kit and non-emergency supplies were inspected and found complete. Per the provider, there are no pets in the home, transportation is not provided, and medication is not administered. Three caregivers' records and five children's records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-890
Description: Based on observations and interviews, the provider did not ensure that when food is brought from home, the food container shall be clearly labeled in a way that identifies the owner.

Evidence: On 05/28/24, the inspector observed three lunch boxes that belonged to children in care. The lunch boxes were not labeled in a way that identified the owner.

During interviews, Caregiver #1 acknowledged the lunch boxes were not labeled.

Plan of Correction: Corrected during the inspection. The lunch boxes will be labeled moving forward.

Standard #: 8VAC20-800-960-E
Description: Based on observations and interviews, the provider did not ensure that bottles shall be refrigerated and labeled with the child's full name and the date, if more than one infant is in care.

Evidence: On 05/28/24, the inspector observed infant bottles that were not labeled with children's full name and the date.

During interview, Caregiver #1 acknowledged the bottles were not labeled and confirmed there were four infants in care during the inspection.

Plan of Correction: Corrected during the inspection. The bottles will be labeled moving forward.

Standard #: 8VAC20-800-30-A
Description: Based on observations, a review of documentation and interviews, the provider did not ensure compliance with these standards and the terms of the current license issued by the department.

Evidence: 1) The record of Child #4 indicates the child is five-months-old and began attending the family day home on 04/17/24, when the child was four-months-old. Child #4 was observed in care during the inspection on 05/28/24.

2) A review of the terms of the license indicates the family day home may serve children between the ages of 0years, 6 months through 12 years, 11 months.

3) During interview, Caregiver #1 acknowledged Child #4's age does not meet the terms of the current license.

Plan of Correction: The provider stated the child will no longer attend the family day home. To ensure future compliance, the provider will request for a change on the terms of the license to serve children younger than six months.

Standard #: 8VAC20-800-350-E
Description: Based on the water temperature taken and interviews, the hot water taps available to children were not maintained within the range of 105 degrees F and 120 degrees F.

Evidence: 1) On 05/28/24, the inspector tested the hot water tap in the main bathroom sink used by children. The water registered 126 degrees F. 2) The inspector tested the hot water tap in the kitchen sink that is also used by children. The water registered 127 degrees F.

2) During interview, Caregiver #1 acknowledged the hot water temperature was not maintained within the required range.

Plan of Correction: The provider will contact the landlord to ensure the water temperature does not exceed the requirement.

Standard #: 8VAC20-800-530-B
Description: Based on observations and interviews, the provider did not ensure cribs when being used by infants shall have a tight-fitting bottom cover.

Evidence: On 05/28/24, the inspector observed two occupied cribs that did not have a tight-fitting bottom cover.

During interview, Caregiver #1 acknowledged she did not have bottom covers for the cribs.

Plan of Correction: The provider will purchase tight-fitted bottom covers for the cribs.

Standard #: 8VAC20-800-570-A
Description: Based on observations and interviews, the provider did not ensure that a caregiver does not exceed 16 points.

Evidence: On 05/28/24, from 10:10am to approximately 10:35am, the inspector observed 12 children, totaling 35 points, in the care of two caregivers. A third caregiver arrived at the family day home at approximately 10:35am.

During interview, Caregiver #1 acknowledged each caregiver exceeded 16 points until the third caregiver arrived.

Plan of Correction: Corrected. The provider will be mindful of each point assigned to each child to ensure each caregiver does not exceed 16 points each.
