Technical Assistance:
Licensing Inspector provided Technical Assistance (TA) for 8VAC20-780-580 M.
Staff handbook states: "Teachers may decide and are encouraged to conduct short, unannounced field trips including but not limited to walks as a class around the perimeter of the building and/or nearby neighborhoods; trips to local playgrounds; trips to local businesses." This policy must be removed from the handbook. The Standard: 8VAC20-780-580 M, states "if a blanket permission is used instead of a separate written permission, the following shall apply: 1. Parents shall be notified of the field trip; and 2. Parents shall be given the opportunity to withdraw their children from the field trip."

Comments:
An announced initial inspection was conducted on February 9, 2023. There were no children in care during this inspection as the center has not yet opened for child day care purposes. The center is requesting a licensed capacity for 75 children ages six weeks to five years.
The program will offer snacks and a lunch to children in care. The center has submitted all of the required application materials at this time. During the inspection, compliance with some standards could not be determined since the center is not yet in operation. Compliance with these standards will be determined during unannounced visits once the program is in operation. Though some standards of care could not be determined during the initial study, the center i compliance with the standards that could be determined.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and the date to be corrected for each violation listed on the violation notice and return it to the department within 5 business days from receipt. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures

Violations:
Standard #: 8VAC20-780-270-A
Description: Based on observation, the center did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe, and operable condition.

Evidence:
1. The door leading to the playground had a long metal trim piece alongside the length of the door, the metal was not securely fastened so it moved back and forth which could entangle clothing or snag skin.
2. Trash/litter was observed and included plastic bags, chip wrappers, paper towels, and cups.
3. The outside dryer vent did not have a cover.
4. One picket (board) of the wooden fence was broken and laying on the ground with nails protruding from the wood.
5. The gate lock and brackets were broken and hanging from the gate and were unable to be used.
6. The chicken wire running along the bottom of the fence boards of the playground had some sharp edges sticking out in multiple sections of the fence.
7. The metal gutter running from the roof to the ground had a metal piece with sharp corners protruding outwards.
8. A utility steel box located on the playground was sticking above the ground posing a tripping hazard.

Plan of Correction: Will remove trash and repair areas on the playground.

Description: Based on observation, a diaper changing area did not have a sink with running warm water.

Evidence:
In bathroom #1, there is a diaper changing area. The bathroom did not have a sink with running warm water.
