8VAC20-790 Subsidy Regulations

Comments:
A Subsidy Health and Safety Inspection (SHSI) was conducted on 3/18/24 from 11:00am to 1:00pm. A code compliance inspection was conducted on the same date as the SHSI inspection. The two inspections combined cover all subsidy health and safety requirements. Only subsidy requirements not covered in licensing standards were reviewed during this supplemental inspection. The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice and discussed during the exit interview.

Violations:
Standard #: 8VAC20-790-540-B
Description: Based on record review, it was determined the vendor did not ensure that each child's record contained all of the required components.
Evidence:
1.The records for child #1, child #2, child #3, and child #4 did not contain the address for the emergency contacts.
2. The record for child #1 and child #2 did not contain proof of viewing identity.
3. The Administrator confirmed the proof of identity and emergency contact addresses were not in the record.

Description: Based on record review and interview, it was determined the vendor did not ensure that staff records contain the date of employment.
Evidence:
1. The records for staff #1 and staff #4 do not contain the first date of employment.
2. The Administrator confirmed the records for staff #1 and #4 did not have documentation of the first date of employment.

Standard #: 8VAC20-790-600-C
Description: Based on record review and interview, it was determined the vendor did not ensure that orientation training for staff is completed on facility specific topics prior to the staff member working alone with children and within seven days from the date of employment. or the subsidy vendor approval.
Evidence:
1.There was no documentation in the records for staff #1, #3, and #4 that facility specific orientation was completed.

Standard #: 8VAC20-790-630-A
Description: Based on observation, it was determined the vendor did not ensure that areas and equipment of the center inside and outside, were maintained in a safe condition.
Evidence:
1.There was a nail head sticking out of a loose, unattached stair spindle leading from the main childcare room to the outdoor playground. The Administrator pushed the spindle back into place, however, the nail head still protruded posing a scratch or skin snag hazard.

Standard #: 8VAC20-790-790-A
Description: Based on record review and interview, it was determined the vendor did not have a written emergency preparedness plan that addressed all the requirements including; staff responsibility and facility readiness with respect to emergency evacuation, relocation, lockdown and shelter-in-place procedures. The plan shall address the most likely to occur emergency scenarios, including severe storms, loss of utilities, natural disaster, chemical spills, intruder, and violence on or near the facility, and facility damage or other situations that may require evacuation, lockdown, or shelter-in-place.
Evidence:
During the inspection the vendor was unable to provide the emergency response plan.

Description: Based on a record review and interview, it was determined the vendor did not ensure a record of the dates of practice drills was maintained.
