Comments:
An unannounced code compliance inspection for the religiously exempt child day center was conducted on 03/07/2024. There was a total of 5 children, ages 3 years-4 years, 1 staff, and 2 additional adults present during the inspection. A total of 5 children?s records and 3 staff records were reviewed during the inspection. The inspector arrived at 10:05 am and departed at 12:00 pm.

Information gathered during the inspection determined there to be violations of applicable laws. Those violations are detailed on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.031-A-4
Description: Based on record review, the provider failed to obtain documentation that each person in a supervisory position has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.

Evidence:
1. The record for Staff 1 did not contain documentation that Staff 1 has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.
2. The record for Staff 3 did not contain documentation that Staff 3 has been certified by a practicing physician or physician assistant to be free from disability which would prevent him from caring for children under his supervision.

Plan of Correction: The staff will get the form completed by their doctors.

Description: Based on record review, the provider failed to ensure that all children in the center are in compliance with the Code of Virginia regarding the immunization of children against certain diseases.

Evidence:
1. There was no evidence that Child 1 was in compliance with the immunization requirements for children; Child 1 was observed in care during the 03/07/2024 inspection.
2. There was no evidence that Child 3 was in compliance with the immunization requirements for children; Child 3 was observed in care during the 03/07/2024 inspection.

Plan of Correction: Moving forward, this information will be obtained prior to the child's first day of attendance.

Standard #: 22.1-289.035-B-2
Description: Based on document review and staff interviews, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence:
1. Staff 1 has been employed by the center since May 2023. The employment eligibility letter in the record for Staff 1 (dated 05/11/2023) was conducted by a different religiously exempt child day center; background checks are nontransferable, and this criminal record check was not valid for this provider. Staff 1 was observed working during the inspection.
2. Staff 2 has been employed by the center since May 2023. There was not an employment eligibility letter in the record for Staff 1 available for review during the inspection.
3. Staff 3 has been employed by the center since November 2023. The employment eligibility letter in the record for Staff 3 (dated 11/28/2023) was conducted by a different religiously exempt child day center; background checks are nontransferable, and this criminal record check was not valid for this provider.

Plan of Correction: The information will be requested and moving forward, will be obtained prior to hire.

Standard #: 22.1-289.049-A
Description: Based on record review, the provider failed to obtain, upon enrollment, information regarding the child?s previous child day care and schools attended by the child and the proof of the child?s identity and age.

Evidence: There was no information regarding the child?s previous child day care and schools attended by the child and the proof of the child?s identity and age for Child 1 available for review during the 03/07/2024 inspection.

Plan of Correction: Moving forward, this information will be obtained prior to the child's first day of attendance.

Standard #: 8VAC20-770-40-D-2
Description: Based on record review, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation and to obtain the findings from a search of the central registry within 30 days of employment.

Evidence:
1. Staff 2 has been employed by the center since May 2023. There was not a sworn statement or affirmation in the record for Staff 2. A sworn statement or affirmation was not obtained prior to the persons employment.
2. Staff 3 has been employed by the center since November 2023. There was not a sworn statement or affirmation in the record for Staff 3. A sworn statement or affirmation was not obtained prior to the persons employment.
3. Staff 1 has been employed by the center since May 2023. The search of the central registry in the record for Staff 1 (dated 05/18/2023) was conducted by a different religiously exempt child day center; background checks are nontransferable, and this search was not valid for this provider. Staff 1 was observed working during the inspection.
4. Staff 2 has been employed by the center since May 2023. The search of the central registry in the record for Staff 2 (dated 05/28/2023) was conducted by a different religiously exempt child day center; background checks are nontransferable, and this search was not valid for this provider.
5. Staff 3 has been employed by the center since November 2023. The search of the central registry in the record for Staff 3 (dated 11/28/2023) was conducted by a different religiously exempt child day center; background checks are nontransferable, and this search was not valid for this provider.
