Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/. Comments:
An unannounced, on-site monitoring inspection was initiated on 07/24/2024 and completed on 07/24/2024, as a part of the current licensure period. The on-site inspection began at 11:40am and ended at 12:59pm. The inspector reviewed compliance in the areas listed above. There was 1 child present and 1 caregiver; the point total was 4. The inspector reviewed 2 children?s records, 1 caregiver record, and 1 household member record on-site on 07/24/2024. This inspection included document review and a tour of the family day home.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.036-B-1
Description: Based on record review, the provider did not have a record of a sworn statement or affirmation for a household member.

Evidence:
Household member #1 was missing the Sworn Statement or Affirmation disclosure.

Plan of Correction: Will have the Sworn Affirmation or Disclosure statement completed.

Standard #: 8VAC20-800-50-A
Description: Based on record review, the provider did not keep a written record of children in attendance each day.

Evidence:
1.The attendance record shows that the last entry was made on 07/19/2024.
2. Attendance record was missing for 07/22/2024 and 07/23/2023.

Plan of Correction: Will make sure to take attendance on a daily basis going forward. Updated attendance sheet today.

Standard #: 8VAC20-800-430-B
Description: Based on observation, pressure mounted gates was used as protective barriers at stair openings.

Evidence:
1. Pressure mounted gate was used by the stairs located near the front door.
2. Pressure mounted gate was used for the stairs leading to the outdoor playground.

Plan of Correction: Will remove and replace the pressure mounted gates with the correct gates.
