8VAC20-790 Subsidy Program Vendor Requirements for Family Day homes

Technical Assistance:
The vendor was provided information on how to complete the background checks through the county by the county representative. The Licensing representative informed the vendor regarding the requirements for licensing and instructed her on how to obtain additional information regarding obtaining a license.

Comments:
A complaint inspection was conducted on May 7, 2024 from approximately 1:00pm until 2:00pm regarding capacity and household members. There were 5 children in care and no children living in the home under the age of 12 present with the vendor and an assistant caregiver. During the inspection, another family attempted to drop their child off for care but the vendor turned them away. There was a preponderance of evidence therefore the complaint is valid. Information gathered during the inspection determined areas of non-compliance with applicable regulations or law, and violations were documented on the violation notice issued to the vendor.

Standard #: 8VAC20-790-170-C
Description: Based on interview and record review, the vendor did not ensure all household members and caregivers completed all required background checks.

Evidence: The vendor stated Household member 1 and Caregiver 1 do not have completed background checks through the county.

Plan of Correction: we sent the documents that you left me for background check.

Standard #: 8VAC20-790-170-D
Description: Based on observation, the vendor exceeded the capacity of the children cared for as allowed by law.

Evidence: The vendor was caring for 5 children and is permitted to care for a maximum of 4 children. During the inspection, the vendor turned a family away who were seeking care for their child.

Plan of Correction: One of the children is no longer in the daycare.
