Technical Assistance:
Staff records must contain the staff's job title, date of employment, and documentation that the individual possesses the education, certification, and experience required by the job position. 8VAC20-780-70-1 & 4

Comments:
A monitoring inspection was conducted on 04/30/2024 from 12:50 PM to 3:15 PM. There were 58 children present, ranging in ages from infant to five years. The inspector reviewed compliance in the areas of administration, staff qualifications and training, physical plant, staffing and supervision, programming, and special care and emergencies. A total of five children?s records and five staff?s records were reviewed.
Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the facility.
Please return a signed and dated copy of each page of this notice to the licensing inspector no later than on 5:00pm 06/11/2024. If you?d like to include a plan or correction and date to be corrected for each violation cited, please include that information with the signed and dated copy of the Violation Notice by the deadline. Plans of correction should include steps to correct the noncompliance with the standard and measures to prevent the noncompliance from occurring again.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment and a search of sex offender registry prior to the first day of employment for any state in which a staff member resided in the preceding five years.

Evidence:

The sworn statement for staff 3, first date of employment 3/11/24, documented the staff member lived out of the state of VA within the last five years. There was no documentation of an out-of-state sex offender search or central registry background check completed for the other state listed.

Plan of Correction: On the date of the inspection, the assistant director and director completed the FL sex offender search for the staff member. She was not on the list. We had accidently searched for criminal background instead of the sex offender list. We will ask for clarification when in doubt

Standard #: 8VAC20-780-210-A-4-a
Description: Based on record review and interview, the center failed to ensure program leaders completed within six months before being promoted or beginning work or one month after being promoted or beginning work a minimum of 16 hours of training in child related topics that included: child development; playground safety; health and safety issues; and preventing and preventing child abuse and neglect.

Evidence:

The record for staff 2 list the job title as lead teacher. The training qualifications to be lead did not include documentation of completing training in playground safety.

Plan of Correction: All Program Leaders have completed all required trainings as 5/24. All staff completed the playground safety training. Playground safety is now part of our staff onboarding process.

Standard #: 8VAC20-780-330-B
Description: Based on observation, the center failed to ensure that the use zone on all sides of stationary equipment has at least six feet of resilient surfacing.

Evidence:

The climbing wall only has two feet of resilient surfacing.

Plan of Correction: Additional mulch has been purchased and spread around climbing structures. Purchased in early May and June. We will check depth of mulch weekly.
