Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was conducted on June 3, 2024, from approximately 1:30pm to 3:10pm. At the time of the inspection, 68 children were in care with 3 staff members present. Inspected today were the physical plant, 8 children?s records and 9 staff records, evacuation drills, emergency supplies, and policies, medications, and medication authorization records. Children were observed during afternoon check-in, announcements, snack time, and engaged in handwashing. There was an adequate number of staff with current certification in CPR, 1st Aid, and MAT. Areas of non-compliance are identified on the violation notice. Repeat violations were found and are identified within this report.

Standard #: 8VAC20-780-350-B-5
Description: Based on observation and interview, the center did not ensure that the required school age ratio was maintained when children were in care. The school age ratio for children school age eligible-9 years is 1:18.

Evidence:
1. Three staff were observed with 68 school age children from approximately 2:40pm until approximately 3:15pm when a fourth staff arrived.
2. Administration acknowledged that the group was out of ratio due to a teacher not returning from vacation, and a call-out for illness.
3. Staff #1 observed taking a group of 23 children into the hallway of the school to use the bathroom, leaving 45 children with 2 staff in the cafeteria.
