Comments:

Licensing Inspector conducted an unannounced Religiously Exempt Code Monitor Inspection on June 28, 2023. There were 102 children ages 8 months to 9 years old present under the direct care of 14 staff. The Licensing Inspector reviewed 5 children records and 5 staff records, along with any requested program records submitted by the facility to determine if required documentation was complete. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program. Monique D. Description:	Based on record review and discussion with Center Director, the Center failed to complete out-of-state background checks for staff who have lived out of state in the past five years - Criminal record check & sex offender check before 1st day of employment and child abuse & neglect (CPS) check requested within 30 days of employment. EVIDENCE: Licensing Inspector reviewed 5 staff records. Staff #1 indicated on the Sworn Disclosure that they had lived out-of-the state within 5 years prior to employment. Out-of-state Background Checks have not been completed. Employment date for Staff #1 1/23/2023 Staff #3 indicated on the Sworn Disclosure that they had lived out-of-the state within 5 years prior to employment. Out-of-state Background Checks have not been completed. Employment date for Staff #3 4/05/2023.
Plan of Correction:	The provider must send documentation to the Licensing Inspector that the background checks have been requested no later than 10 days following this notification date (6/29/2023)

Description:	Based on review of staff information, the Center failed to ensure each employee, volunteer or any other person who is expected to be alone with one or more children enrolled in a religious exempt child day center has completed Sworn Disclosure Background Check before employment/commencement of service and Central Registry Background Check within 30 days of employment/commencement of service. EVIDENCE: Licensing Inspector reviewed 5 staff records. Records for Staff #1, #3, and #4 did not include documentation of a completed Child Protective Services Background check within 30 days of employment. Employment date for Staff #1 1/23/2023, Staff #3 4/05/2023 and Staff #5 5/24/2023.
