22VAC40-131 PERSONNEL 22VAC40-191 BACKGROUND CHECKS FOR CHILD WELFARE AGENCIES

Comments:

A monitoring inspection was initiated on 6/21/2024 and concluded on 06/26/2024. The Executive Director was contacted initiate the inspection. The Executive Director reported that 13 children in placement. A list of documents required to complete the inspection was provided to the Executive Director. Background checks were reviewed for three provider homes and five staff. A review of findings and exit were conducted on 6/26/2024 where an opportunity was given for questions, as well as for providing any information or documentation which was not available during the inspection. Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and violations were documented on the violation notice issued to the facility. Inspection findings will be posted to the Department?s public website within 5 days of receipt of the inspection documents. The department's inspection findings are subject to public disclosure. The licensee has the opportunity to submit a plan of correction to indicate how the cited violation(s) will be addressed in order to return the facility to compliance and maintain future compliance with applicable standard(s) or law. If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview. Compliance with all applicable regulations and law shall be maintained and any areas of noncompliance must be corrected. Within 15 calendar days of your receipt of the inspection findings (inspection summary, violation notice, and supplemental information), you may request a review and discussion of these findings with the inspector's immediate supervisor. To make a request for review and discussion, you must contact the licensing supervisor at the regional licensing office that serves your geographical area. Regardless of whether a supervisory review has been requested, the results of the inspection will be posted to the DSS public website within 5 business days of your receipt of the Inspection Summary and/ or Violation Notice. Description:	Violation: Based on a documentation review and interview, the agency failed to ensure required background checks for Staff 2, 3, and 4 (S2, S3, and S4) were dated no more than 90 days prior to the date of employment. Evidence: 1) S2 was hired 5/8/2024. Central registry search results for S2 were dated 1/30/2024. Criminal history search results for S2 were dated 2/1/2024. 2) S3 was hired 4/1/2024. Central registry search results for S3 were dated 12/14/2023. Criminal history search results for S3 were dated 12/15/2023. 3) S4 was hired 4/19/2024. Central registry search results for S4 were dated 11/15/2023. Criminal history search results for S4 were dated 12/8/2023.
