Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A renewal inspection was initiated on March 15, 2021 and concluded on March 19, 2021. The Child Placing Supervisor was contacted by telephone to initiate the inspection. The inspector emailed the Child Placing Supervisor a list of items required to complete the inspection. The inspector reviewed portions of two personnel records, one youth?s record, and background checks for two agency representatives submitted by the agency to ensure documentation was complete. Exit meeting was held with the Child Placing Supervisor on March 19, 2021. The agency reports they are implementing their COVID-19 policies and procedures.

Information gathered during the inspection determined non-compliance with applicable standards or law, and a violation was documented on the violation notice issued to the agency. Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return to the Licensing Office within 5 business days from receipt of the inspection documentation. You will need to specify how the deficient practice will be or has been corrected (merely writing the word corrected is not acceptable). Your plan of correction must contain the steps to correct the noncompliance with the standard(s), the measures to prevent the noncompliance from occurring again; and the position responsible for implementing each step and/or monitoring any preventive measure(s). The licensee should retain a copy to be posted at the agency. Results of the inspection documentation are subject to public disclosure and will be posted on the VDSS web site within 5 days, regardless of whether the Plan of Correction is completed.

Description: Violation:
Based on review of the background checks for agency representative AR2 and interview with Staff S1, the agency failed to obtain a sworn disclosure statement, a criminal history record, and a search of the central registry before three years since the date of the most recent sworn disclosure statement, criminal history record, and central registry finding

Findings:
1. The most recent sworn disclosure statement for AR2 is dated 09/27/2017 and is titled, ?Sworn Statement or Affirmation for Adult Facility Employees?.
2. During the inspection, Staff S1 forwarded a current ?Sworn Statement or Affirmation for Child-Placing Agencies? signed and dated 03/19/2021.
3. The criminal history record for AR2 is dated 10/06/2017.
4. The central registry for AR2 is dated 10/31//2017.
5. Staff S1 acknowledged the background checks were out of compliance.

Plan of Correction: Human Resources Director/Department established a MS Excel tracking spreadsheet and MS Outlook E-Calendar Invitation protocol to ensure the respective employees and Board Members maintain appropriate 3-year renewals of background checks and associated documentation. All remainders are scheduled to be sent sixty (60) days prior to renewal due date with appropriate follow up action from the HR team to ensure compliance. System and process will be maintained and executed by HR Department. Appropriate coordination will occur Executive Director or designee and Child Placing Supervisor. AR2 completed an appointment with Fieldprint? Fingerprinting to have a criminal history records search completed.
