22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
An unannounced monitoring inspection was conducted on December 17, 2019 from 11:00 a.m. to 4:00 p. m and December 19, 2019 from 8:30 a.m. to 1:40 p.m. at Intercept Health located at 11961 Ironbridge Road Chester, Virginia 23831. Personnel records were reviewed on 11/07/2019 at Intercept Health located in Richmond, Virginia. Intercept Health-Chester continues to provide foster care, treatment foster care and short term foster care services. At the time of the inspection the agency reported twenty-eight (28) children in care and twenty-eight (28) approved provider homes.

During the inspection, the following activities transpired:

1.Reviewed three (3) provider home records (entire record)
2.Reviewed one (1) additional provider home record (background and health records only)
3.Reviewed three (3) foster child records
4.Personnel Records were reviewed at the Henrico Office on 11/07/2019.
5.Interviews with agency representatives were conducted.

An exit meeting was conducted with the Program Supervisor and Documentation Specialist on December 19, 2019 at 1:00 p.m. to discuss preliminary inspection findings.

There were three (3) citations for violations of the Standards for Child Placing Agencies. Upon receipt of the violation notice, the licensee must develop a plan of correction for each violation. The plan of correction must include the following: the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which non-compliance will be corrected.

The licensee has five (5) calendar days from receipt of the inspection documentation to complete the section entitled "Plan of Correction", sign each page of the Plan of Correction and return it to the Licensing Office. The licensee retains a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the VDSS web site within five (5) days, regardless of whether or not the Plan of Correction has been completed.

Violations:
Standard #: 22VAC40-131-140-G-2
Description: Based on a review of the personnel file for Staff (S)3 and based on an interview with the agency representatives, the licensee failed to document a written training program listing topics to be covered during the period of time the individual is a trainee.

Findings:
1.Based on a review of the personnel record for S3, there was no document a written training program listing topics to be covered during the period of time the individual is a trainee.
2.During an interview with AR5, she acknowledged the absence of documentation of a written training program listing topics to be covered during the period of time the individual is a trainee.

Plan of Correction: In response to the 22VAC40-131-(3)-140-G-2 violation, TFC Director will provide training to all TFC supervisors and TFC Regional Supervisors regarding appropriate documentation to be placed in a trainee?s file to include written training program listing topics to be covered during the period of time the individual is a trainee.

Standard #: 22VAC40-131-230-F-1
Description: Based on a review of the foster home record for FH2 and based on an interview with an agency representative, the licensee failed to for each child placed since the last evaluation, write a brief description of the child?s adjustment to the family and the home at the time of the re-evaluation.

Findings:
1.Applicable sections of the ?Foster/Adoptive Home Re-Evaluation? form that was located in the record at the time of the review was left blank. When the licensing representative requested a copy of this documentation, the blank sections were missing on the printed copy.
2.During this interview AR1 acknowledged that the applicable information was missing from the record at the time of the review of the record. During an interview with AR1, she stated that the printed copy came from the assigned worker?s computer and that the assigned worker?s supervisor is working with the assigned worker on completing this documentation correctly.

Plan of Correction: In response to the 22VAC40-131-(5)-230-F-1 violation, TFC Director will provide training to FSS Supervisor and FSS staff regarding appropriate documentation to be placed in the foster home record, to include a brief description of the child?s adjustment to the family and the home at the time of the re-evaluation.

Standard #: 22VAC40-131-340-F-1
Description: Violation: Based on the review of the record for FC2 and based on an interview with agency representatives, the licensee failed to document in the child?s record, the birth parents involvement in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary.

Findings:
1.According to the available documentation in the record there was no documentation of the birth father?s involvement in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary.
2.The documented goal is return home. According to the documentation the parental rights have not been terminated. There was no documented reason related to the inappropriateness of the father?s involvement in developing the child?s individualized service plan, treatment plan and quarterly progress reports.
3.During an interview with AR1, AR3 and AR4, it was determined that the father had a court order to engage in anger management and other court orders. However, AR1, AR3 and AR4 acknowledged that there was no documented reason why the birth father could not participate in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary.

Plan of Correction: In response to the 22VAC40-131-(6)-340-F-1 violation, TFC Director will provide training to TFC staff and supervisors regarding appropriate documentation to be placed in the child?s record, to include the birth parents involvement in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary.
