Technical Assistance:
Discussed the records of each staff person including relevant work experience, providing dates, places of employment, and details substantiating qualifications as noted in the ?Standards for Licensed Child Placing Agencies? - 22VAC40-131-160.B.2.

Discussed the elements of the written agreement for participation in the arrangement with the youth, guardian, and as appropriate, the family as noted in the ?Standards for Licensed Child Placing Agencies?- 22VAC40-131-440.E.

Comments:
An unannounced monitoring inspection was completed by the Licensing Specialist on 12/21/21 from 12:13 p.m. to 6:49 p.m. and 12/22/21 from 10:42 a.m. to 6:56 p.m. The current census is four (4) residents.

The following is a listing of the activities for this inspection:
One youth record was reviewed. Three staff records were reviewed, which consist of the two newest staff members hired since the May 2021 monitoring inspection.

On 12/21/21 and 12/22/21, the Executive Director and the Senior Case Manager were available and accessible during the inspection. On 12/22/21, these staff members were interviewed in order to seek clarification about several elements. Preliminary findings were also discussed on the same date. The Acknowledgment of Inspection form was signed and left at the agency on both dates.

Upon receipt of this violation notice, a plan of correction is requested for the violations. The Plan of Correction should include, as appropriate: - steps to correct noncompliance of a regulation, - measures to prevent reoccurrence of noncompliance, - person(s) responsible for implementing each step and/or monitoring any preventive measure(s), and - the date by which the noncompliance will be corrected. Be advised that the Violation Notice, including the Plan of Correction and this Summary page will be posted on the VDSS web page and available for review by the general public. Do not write any names or other confidential information into your plan of correction. The licensee should retain a copy of this document to be posted at the facility. The results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services? website within 5 business days.

Violations:
Standard #: 22VAC40-131-40-B
Description: Based upon an interview and review of staff?s, S1?s, personnel record, the agency failed to comply with their own policies and procedures.
Findings:
1) The job description for the Life Skill Coach states the following as it pertains to ?Minimum Knowledge, Skills, and Abilities Required? ? ?One (1) year of experience in the related field.?
2) S1 has occupied the Life Skills Coach position for 62 days.
3) S1?s resume shows that S1 had nine months of experience in the related field.
4) S4 was interviewed about S1?s resume. S4 reviewed S1?s resume and acknowledged the findings.

Plan of Correction: The agency?s first step to correct noncompliance of the regulation was the termination of S1 employment. The next step being implemented will be to have at least 2 persons review future employee candidate?s resumes to ensure compliance with company policies and procedures. The executive director will be responsible for implementing the procedure. The executive director and the child-placing supervisor or other employee designee will be responsible for monitoring the preventive measure.

Standard #: 22VAC40-131-160-B-7
Description: Based upon an interview and review of staff?s, S2?s, personnel record, the agency failed to include the date of separation for the position held with the licensee in the record.
Findings:
1) S2 was hired by this agency in 2018. She was rehired in 2021 for the same position.
2) Upon review of the personnel record, the date of separation from employment for the initial hire in 2018 was not in the personnel record for this staff person.
3) S4 was interviewed about S2?s separation date. S4 advised that S2 separated or resigned from the agency in 2020.
4) S4 acknowledged that S2?s separation date was not in S2?s record.

Plan of Correction: The records of each staff person shall include a date of separation for each position held with the agency. To correct the noncompliance of regulations, a date of the original separation from the agency and the subsequent rehire of S2 has been correctly identified in the employee?s personnel file. To prevent reoccurrence of noncompliance, the agency will develop a tracking system to monitor dates of hire and termination dates. The executive director will be responsible for the implementing of each step and monitoring any preventive measures.

Standard #: 22VAC40-191-40-B
Description: Based upon an interview and review of the staff?s, S1?s, personnel record, the agency failed to comply with ensuring no person with a disqualifying background who has not been granted a waiver according to 22VAC40-191-90 may operate or volunteer or work at a facility governed by this chapter.
1) Upon review of S1?s personnel record, it contains a Virginia Criminal Record, which includes a barrier crime.
2) The crime is a conviction of a barrier crime as defined in ? 19.2-392.02 of the Code of Virginia.
3) S1?s barrier crime was discussed with S4. S4 reported he was not aware that S1?s Virginia Criminal Record included a barrier crime. S1 has not been granted a waiver.

Plan of Correction: The agency will comply with ensuring that no person with a disqualifying background who has not been granted a waiver according to 22VAC40-191-90 may operate or volunteer or work at a facility governed by this agency. An employee of the agency who is involved in the day-to-day operations or who is alone with, in control of, or supervising one or more children shall have a search of the central registry and criminal history record check completed before 30 days of employment. To correct the noncompliance S1 employment was terminated immediately. The executive and an assigned staff member will be responsible for implementing each step and/or monitoring any preventive measures, which includes reviewing the Virginia criminal Record for any barrier crimes.
