Comments:
An unannounced renewal inspection was completed by the Licensing Specialist on 3/8/22 from 9:40 a.m. to 2:13 p.m. This location has a census of zero (0).

The following is a listing of the activities for this inspection:
Four staff records were reviewed.

The Manager of Compliance and Development was available and accessible during the inspection. On 3/8/22, the Manager of Compliance and Development was interviewed in order to seek clarification about several documents reviewed. Preliminary findings were also discussed on the same date. The Acknowledgment of Inspection form was signed and left at the agency.

Upon receipt of this violation notice, a plan of correction is requested for the violation. The Plan of Correction should include, as appropriate: - steps to correct noncompliance of a regulation, - measures to prevent reoccurrence of noncompliance, - person(s) responsible for implementing each step and/or monitoring any preventive measure(s), and - the date by which the noncompliance will be corrected. Be advised that the Violation Notice, including the Plan of Correction and this Summary page will be posted on the VDSS web page and available for review by the general public. Do not write any names or other confidential information into your plan of correction. The licensee should retain a copy of this document to be posted at the facility. The results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services? website within 5 business days.

Violations:
Standard #: 22VAC40-191-40-D-1-c
Description: Violation: Based on interviews with staff and review of staff?s, S1?s, personnel record, the agency failed to comply with the requirements for background checks before three years since the date of the last sworn statement and most recent criminal history record check report.
Findings:
1) The following was observed while reviewing S1?s personnel file-
a. The received dates on the sworn statements and the criminal history record check reports confirms these background checks were not obtained before three years since the date of the previous background checks.
b. The current sworn statement is dated for 2/4/22. The previous sworn statement is dated for 1/31/19.
c. The current criminal history record check is dated for 2/7/22. The previous criminal history record check is dated for 1/30/19.

2) Staff, S5, was interviewed about the sworn statements and the criminal history record checks.
a. S5 was not able to provide a background check conducted before three years since the date of the last sworn statement and last criminal history record check.
b. S5 acknowledged the findings.

Plan of Correction: Executive director will ensure the HR department is fully
trained and aware of the LCPA personnel regulations
around background checks, sworn statements and criminal
history checks
