63.2 General Provisions.
22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
This inspection was conducted by licensing staff using an alternative remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 12/28/2020 and concluded on 01/05/2021. The Program Director was contacted by email to initiate the inspection. There were 10 children in care, and 16 approved provider homes. The agency reports 2 new staff since the last inspection. The inspector emailed the Program Director a list of items required to complete the inspection. The inspector reviewed 2 children?s records, 2 provider home records, and 2 staff records submitted by the agency to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the agency. Any violations can be found on the violation notice. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of correction," sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public website within five business days, regardless of whether or not the Plan of Correction is completed.

Violations:
Standard #: 22VAC40-131-200-A-3
Description: According to the electronic record reviewed for Foster Home (FH) 1 and based on an interview with Agency Representatives (AR), the licensee failed to consider all information gathered when assessing the applicant?s capabilities to care for children.
Findings:
(1)Based on the records reviewed, the record contained a form titled ?Foster Parent Reference (for Foster Care Agency)? which contained a statement regarding concerns with the foster parent?s capability to care for other children based on the biological daughter?s behaviors (Supplemental Form-Behavior Statement A).
(2)Based on the management of the biological daughter?s behaviors (Behavior Statement A), there was no documentation that assess the foster parents? capability to care for other children.
(3)During the exit interview, AR-8 referenced a section on ?Home Study B? where this information ?should have been? documented and acknowledged that this information was not considered.
(4)During the exit interview, AR-6 and AR-7 referenced a section located on ?Home Study B? that stated that the foster parent would not accept youth that exhibited Behavior Statement B. However, they reviewed the record and were not able to provide documentation that clearly documented the applicants capabilities to care for other children as it relates to Behavior Statement A.

Plan of Correction: In response to the 22VAC40-131-(5)-200-A-3 violation, TFC Director will train TFC staff regarding the requirement of documenting all information gathered when assessing the applicant?s capabilities to care for children.
