Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

An announced mandated monitoring inspection was initiated on 2/8/2021 and concluded on 2/10/2021. The Regional Manager of Foster Care and Independent Living was emailed a request for information required to conduct the inspection. The Regional Manager of Foster Care and Independent Living returned the required information and provided access to case records. The agency reported 28 children and youth in placement and 31 approved provider homes at the time of inspection. Three (3) foster child and four (4) foster home records were reviewed during this inspection.

The Regional Manager of Foster Care and Independent Living was available during the inspection. The Regional Manager of Foster Care and Independent Living and two (2) Foster Care Supervisors participated in the exit interview on 2/10/2021. There were four (4) citations issued for violations of the Standard for Licensed Child Placing Agencies.

Upon receipt of the Violation Notice, the licensee should develop a plan of correction to include the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of Correction", sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public web site within five business days, regardless of whether or not the Plan of Correction is completed.

Description: Violation

Based on record review and interviews, the agency failed to complete a written assessment within 30 days Foster Child 1 (FC1) being placed.

Findings:

1) FC1 was placed with the agency in October 2020.
2) The case record for FC1 contained a written assessment dated 111 days following the date of placement.
3) The findings were discussed during the exit interview. Staff 1, 2, and 3 (S1, S2, and S3) were interviewed.
4) S1, S2, and S3 reviewed the record and acknowledged the findings.

Plan of Correction: Regional Managers will remind staff of the importance of timely documentation

Description: Violation:

Based on record review and interviews, the agency failed to obtain tuberculosis screening or test results for applicants 1 and 2 (A1 and A2) in Foster Home 1 (FH1) that were no older than 13 months at the time the home was approved.

Findings:

1) The case record for FH1 contained tuberculosis results dated 9/13/2019 for A1 and A2 in FH1.
2) FH1 was approved 11/10/2020, 15 months following the examination date.
3) The findings were discussed during the exit interview. Staff 1, 2, and 3 (S1, S2, and S3) were interviewed.
4) S1, S2, and S3 reviewed the case record and acknowledged the findings.

Plan of Correction: The date of the TB screening cannot be corrected.

Regional Manager will remind staff and supervisors approving any home study to use an electronic date calculator to ensure tuberculosis screening or test results for all household members are no older than 13 months at the time of approval.

Description: Violation:

Based on record review and interviews, the agency failed to obtain medical examinations for applicants 1 and 2 (A1 and A2) in Foster Home 1 (FH1) that were no older than 13 months at the time the home was approved.

Findings:

1) The case record for FH1 contained written medical examination results with examination date of 9/13/2019 for A1 and A2.
2) FH1 was approved 11/10/2020, 15 months following the examination date.
3) The findings were discussed during the exit interview. Staff 1, 2, and 3 (S1, S2, and S3) were interviewed.
4) S1, S2, and S3 reviewed the case record and acknowledged the findings.

Plan of Correction: The date of the medical examinations cannot be corrected.

Regional Manager will remind staff and supervisors approving any home study to use a date calculator to ensure that medical examinations for all household members are no older than 13 months at the time of approval

Standard #: 22VAC40-191-40-D-5-a
Description: Violation:

Based on record review and interviews, the agency failed to obtain Child Protective Services Central Registry Search results (CPS results) for Child 1 (C1) in Foster Home 4 (FH4) within 30 days of the child?s 14th birthday.

Findings:

1) C1 turned 14 years of age in December 2019.
2) C1 lives in an approved foster home and is not a child placed in an approved foster home by a child-placing agency.
3) The case record for FH4 contained CPS results for C1 dated 125 days after the child?s 14th birthday.
4) The findings were discussed during the exit interview. Staff 1, 2, and 3 (S1, S2, and S3) were interviewed.
5) S1, S2, and S3 reviewed the case record.
6) During interviews staff stated the CPS results in the file were received following a second CPS search request submission. Staff stated the first search request was returned due to an error on the form. Staff did not locate documentation in the record of the first CPS search request submission.
7) The licensing inspector provided opportunity for staff to contact other employees in the office in an effort to locate documentation. No documentation was located or provided.

Plan of Correction: Background check cannot be corrected.

Regional Manager will review with staff the requirement that CPS results must be received and in the file within 30 days of the child's 14th birthday
