63.2 General Provisions.

Technical Assistance:
Technical Assistance provided regarding Standard 22VAC40-131-370.F; maintaining up to date and uniformed organized case files.

Comments:
An unannounced monitoring inspection was conducted at The Bair Foundation, Virginia Beach location on July 31, 2019 from 8:45 am to 2:00 pm and on August 1, 2019 from 9:45 am to 4:20 pm. The Bair Foundation continues to provide foster care, short-term foster care and treatment foster care services. The agency reports forty-six children in care and forty-two approved foster homes. During the inspection, the following activities transpired: 1. Five foster home records were reviewed. 2. Five foster child records were reviewed. 3. Seven staff records were reviewed. 4. Serious Incident Reports were reviewed. 5. Policy and Procedures were reviewed. 6. A physical plant inspection of the record keeping area as well as meeting space was conducted. 7. Interviews with agency representatives were conducted. There was one citation for violation of the Standards for Child Placing Agencies. An exit meeting was conducted with agency representatives on August 1, 2019 at 3:30 p.m. to discuss the inspection findings. Upon receipt of the violation notice, the licensee should develop a plan of correction for each violation. The plan of correction should include the following: the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of noncompliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five (5) calendar days from receipt of the inspection documentation to complete the section entitled "Plan of Correction", sign each page of the Plan of Correction and return it to the Licensing Office. The licensee retains a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the VDSS web site within five (5) days, regardless of whether or not the Plan of Correction has been completed.

Description: Based on interviews with AR2 and based on the review of the file for Foster Child (FC) 3 and FC4, the licensee failed to document in the child?s record, the birth parents involvement in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary. Findings: 1. Based on all documentation throughout the child?s file, FC3?s birth father remains involved in the child?s life, maintains contact with the child and his parental rights have not been terminated. 2. Based on all documentation throughout the child?s file, FC4?s birth mother remains involved in the child?s life, maintains contact with this child, engages in supervised visits with the child and her parental rights have not been terminated. 3. Based on documentation in the child?s file, the court goal for FC3 and FC4 is return home. 4. Based on the documentation for FC3 and FC4, there was no documented reason why the birth parent?s involvement would be inappropriate. 5. Based on an interview with AR2, the assigned worker for FC3 faced challenges with communicating with the locally assigned social worker. According to AR2, while they knew that the birth father was involved in the child?s life, the licensee failed to involve him in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary. 6. Based on an interview with AR2, FC4?s birth mother continues to be involved and her parental rights have not be terminated. However, the licensee failed to involve her in developing the child?s individualized service plan, child?s treatment plan as appropriate and quarterly progress reports and in updating the service plan and treatment plans as necessary.

Plan of Correction: All case managers will review case records of current case load to ensure proper documentation of birth parent involvement in developing the ISP, quarterly progress report and all treatment plan updates.

Supervisors will review biological family involvement in weekly supervision to ensure ongoing compliance.

Clinical Director will review ISPs and updates to ensure biological family involvement is occurring.
