Comments:

An unannounced focused inspection was conducted on 8/15/19 from approximately 9:30 a.m. to 2:17 p.m. This inspection was conducted due to a self-reported incident of a physical altercation between a youth and a staff member. The following is a listing of the activities for this inspection: One youth record was reviewed. Two personnel records were reviewed. This was a joint investigation with a local agency representative. Interviews with two residents and two staff members were conducted together at the facility on 8/15/19. The two staff members involved in the incident were interviewed by the Licensing Specialist and the local agency representative on 8/15/19 and 8/16/19. On 8/15/19, the Executive Director and the Program Development Specialist were on site and accessible during the inspection. The Licensing Specialist interviewed these two staff members as well as the Director of Human Resources and Talent Manager at the facility?s corporate office to obtain additional information about the incident. The Acknowledgement of Inspection form was signed and left at the corporate office. Upon receipt of this violation notice, a plan of correction is requested for the violation. The Plan of Correction should include, as appropriate: - steps to correct noncompliance of a regulation, - measures to prevent reoccurrence of noncompliance, - person(s) responsible for implementing each step and/or monitoring any preventive measure(s), and - the date by which the noncompliance will be corrected. Be advised that the Violation Notice, including the Plan of Correction and this Summary page will be posted on the VDSS web page and available for review by the general public. Do not write any names or other confidential information into your plan of correction. The licensee should retain a copy of this document to be posted at the facility. The results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services website within 5 business days.

Description:	Violation: Based on interviews with staff and review of personnel records, S1 (staff) failed to comply with the facility?s policy titled, ?Physical Restraint.? Findings: 1) The facility?s ?Physical Restraint? policy states the following ? ?YouthQuest Village will not perform physical restraints, or use chemical or mechanical, but will call the police when a youth is a threat to self or others.? a. The procedure for this policy consist of the following: ?Most crisis situations are emergency oriented and short-lived, averaging ten (10) to fifteen (15) minutes in duration. Should a youth not respond or begin to moderate his behavior appropriately within this initial 10-15 minute period, the staff involved or on duty should call immediate supervisor for guidance and dial 911 and contact the police for assistance if deemed necessary.? 2) During the interview on 8/16/19, S1 shared his account of what occurred with the foster youth, FY1. a. S1 shared how FY1 became verbally aggressive towards staff while transporting youth back to the facility from the grocery store. b. S1 reported the other youth thanked him for transporting them back to the facility except for FY1. S1 stated that he said the following to FY1, ?You?re welcome." S1 then mentioned hearing FY1 initially mumble under his breath and then began using profanity. S1 stated he told FY1 to go to his apartment. c. S1 reported FY1 did not go to his apartment, but began charging or running towards him. d. S1 stated that once inside the apartment, FY1 became physically aggressive. e. S1 admitted to restraining the youth and stated the following, ?I restrained FY1.? f. S1 further stated the following, ?I grabbed FY1 in order to calm him down. I turned him around really quick and told him to calm down. FY1 bit me.?
