Comments:
An unannounced monitoring inspection was conducted on October 22, 2019 from 9:19 a.m to 4:15 p.m. This agency continues to provide independent living arrangements (ILA). At the time of the inspection, the agency reported 28* youth (*includes children of the youth) placed in independent living arrangements. During the inspection, five personnel records and three youth records were reviewed. Prior to leaving the agency on October 22, 2019, an exit meeting was conducted with the Executive Director to discuss preliminary inspection findings. An acknowledgement form was signed. A final exit meeting was held via telephone with the Executive Director on October 24, 2019.

Upon the receipt of the violation notice, the licensee should identify the necessary corrective action and develop a plan of correction for each violation. The plan of correction should include the following: The steps to correct noncompliance with the standard(s); measures to prevent re-occurrence of noncompliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five (5) calendar days from receipt of the inspection documentation to complete the section titled Plan of Correction, sign each page of the documentation and return it to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection documentation are subject to public disclosure and will be posted on the VDSS web site within 5 days, regardless of whether the Plan of Correction is completed.

Description: Violation:
Based on review of the personnel record for Staff S5 and interview with Agency Representative AR1, the agency failed to obtain a statement from S5 disclosing criminal convictions within or outside the Commonwealth as required by ?63.2-1720.C.1.

Findings:
1.According to the criminal history record check filed in the personnel record for S5, S5 has been convicted of a crime.

2. S5's sworn statement failed to disclose the conviction.

3. AR1 was asked about the discrepancy during the exit interview and AR1 acknowledged that the sworn disclosure failed to disclose the conviction.

Plan of Correction: Executive Director will ensure that all potential employees understand, read, and ask any questions about the sworn statement form before completing the form and signing. Executive Director will also reiterate to all potential employees' standards regarding background checks and what qualifies as a satisfactory versus unsatisfactory background check.
