Discussed the individualized service plan in relation to strengths and needs as noted in the ?Standards for Licensed Child Placing Agencies? - 22VAC40-131-440.I.1.

Type of inspection: Monitoring
Date(s) of inspection and time the licensing inspector was on-site at the facility for each day of the inspection:
12/13/23 from 10:49 AM to 4:57 PM
12/14/23 from 10:34 AM to 5:06 PM

The Acknowledgement of Inspection form was signed and left at the facility for each date of the inspection.

Number of youth in care: 11
The licensing inspector completed a tour of the physical plant that included the office setting and conditions.
Number of youth records reviewed: 1
Number of staff records reviewed: 5
Number of interviews conducted with staff: 4

Additional Comments/Discussion:
An entrance conference was held at the agency on 12/13/23. The Vice-President of Programs was available and accessible on-site during the inspection. The Executive Director was available by phone. The Human Resources Generalist was interviewed while the staff records were being reviewed. In order to obtain clarification about several documents reviewed, the preliminary findings meeting held on 12/14/23 included the following staff members: the Vice-President of Programs, the Vice-President of People, Diversity, and Belonging, and the Executive Director.

The revised version of the Discharge policy as it pertains to ?Involuntary Discharge? was reviewed during this inspection.

An exit meeting was conducted on 2/5/24 to review the inspection findings.

The evidence gathered during the inspection determined non-compliance with applicable standard(s) or law, and violation(s) were documented on the violation notice issued to the facility. The licensee has the opportunity to submit a plan of correction to indicate how the cited violation(s) will be addressed in order to return the facility to compliance and maintain future compliance with applicable standard(s) or law.

If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview.

Compliance with all applicable regulations and law shall be maintained and any areas of noncompliance must be corrected.

Within 15 calendar days of your receipt of the inspection findings (inspection summary, violation notice, and supplemental information), you may request a review and discussion of these findings with the inspector's immediate supervisor. To make a request for review and discussion, you must contact the licensing supervisor at the regional licensing office that serves your geographical area.

Regardless of whether a supervisory review has been requested, the results of the inspection will be posted to the DSS public website within 5 business days of your receipt of the Inspection Summary and/ or Violation Notice.

The department's inspection findings are subject to public disclosure.

Description: Violation: Based upon interviews with staff and review of staff?s, S4?s, personnel record, the agency failed to comply with the requirements for background checks before three years since the last sworn statement or affirmation, the most recent central registry finding and the most recent criminal history record check report.
Findings:
1) The Licensing Specialist reviewed S4?s personnel file and noticed the following-
a. The received dates on the sworn statements, central registry findings, and the criminal history record check reports confirms the current background checks were not obtained before three years since the date of the previous background checks.

2) The Licensing Specialist interviewed S4 and S8 about S4?s background checks.
a. S4 and S8 were unable to provide background checks conducted before three years since the date of the previous background checks.
b. S4 acknowledged the Licensing Specialist?s findings.
