63.2 General Provisions

Comments:
An unannounced monitoring inspection was conducted on December 14, 2021 from 9:30 am to 3:30 pm and December 15, 2021 from 9:30 am to 11:20 pm at the Richmond location. The licensee reports a total of two (2) foster children in care at this location. The licensee reports a total of eight (8) active foster homes for this location. There were two (2) new staff hired since the last inspection.

The following is a list of activities for this inspection:

1. One (1) foster child file reviewed
2. One (1) complete foster home record reviewed
3. Two (2) additional foster home records reviewed (background checks only)
4. Two (2) staff records reviewed.
5. Observations of the physical plant

Staff were available for the preliminary findings/exit interview which commenced at approximately 11:00 a. m. on December 15, 2021 at the Richmond location. An acknowledgement form was signed and left with the licensee at this time. There was one (1) citation for violations of Standards for Licensed Child-Placing Agencies.

Upon receipt of the Violation Notice, the licensee is encouraged to develop a plan of correction to include the steps to correct non- compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of Correction," sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public web site within five business days, regardless of whether or not the Plan of Correction is completed.

Violations:
Standard #: 22VAC40-131-140-B
Description: Based on the review of the personnel files for Staff(S)-2 as well as based on interviews with agency representatives (AR), the licensee failed to ensure that staff hired met the qualifications for the position for which they were hired.

Findings:
1. During the entrance interview, AR-1 provided the inspector with a type written list of current employees. On this list, S-2 is identified as a ?Treatment Foster Care Caseworker.?
2. During the inspection, the personnel file or S-2 was presented for review. The record for S-2 contained signed job descriptions for the position of Caseworker.
3. The qualifications for the Caseworker listed on the job descriptions for S-2 required that the staff meet the qualifications of a caseworker as defined in the standards under 22VAC40-131-140.F.
4. Based on an interview with S-2, based on the resume located in the record, the application and research of previous employment history, it was determined that S-2 did not meet the qualifications as defined in 22VAC40-131-140.F.
