22VAC40-131 ADDITIONAL REQUIREMENTS FOR SPECIFIC PROGRAMS

Technical Assistance:
Discussion occurred regarding 22VAC40-131-290, Medical Examinations and Care. This regulation allows the agency to accept a medical examination report that addresses all required elements and is no more than 13 months old for a child that has been in continuous placement of a public or private child-placing agency. When accepting such medical examination report, regulation requires the agency to also obtain a report of all medical treatment provided to the child from the date of the medical examination to the date of admission of the child to the licensee?s program. The information is to be documented in the child?s case record. The licensing inspector provided clarification that medication management appointments are to be included in the report of treatment received between the medical examination report and the date of placement.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary
due to a state of emergency health pandemic declared by the Governor of Virginia.

An announced mandated monitoring inspection was conducted on 8/21/2020. The Executive Director was contacted by email to initiate the inspection. The inspector emailed the Executive Director a request for documentation required to complete the inspection. The agency reported ten (10) children and youth in placement. One (1) foster child record was reviewed during this inspection.

The Executive Director participated in the entrance conference and remained available during the inspection. The Executive Director, Assistant Director, and Program Manager participated in the exit interview. One (1) violation of the Standards for Licensed Child Placing Agencies were cited.

See the violation notice on the Department?s public web site for violations of the Standards. Upon receipt of the Violation Notice, the licensee should develop a plan of correction to include the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of Correction", sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public web site within five business days, regardless of whether or not the Plan of Correction is completed.

Description: Violation:

Based on record review, the agency failed to address all required elements in the Social History for Foster Child 1 (FC1).

Findings:
The case record for FC1 contained a Social History completed within 45 days of the child?s placement. The Social History did not document the child?s previous placement history, including dates and names of previous caretakers. The case record did contain a report from the last placement prior to the child?s placement with the agency. The findings were discussed during the exit interview. Staff 1, 2, and 3 (S1, S2, and S3) reviewed the Social History. S1 acknowledged the information was not documented in the Social History.

Plan of Correction: 22VAC40-131-(6)-260- B-5: Executive director will ensure all case workers and case work supervisors are fully trained to include all necessary requirements of the social history to include names of foster parents in placement history.
