Type of inspection: Monitoring
Date(s) of inspection and time the licensing inspector was on-site at the facility for each day of the inspection: 8/2/2022 from 9:45 a.m. to 2:55 p.m. An entrance conference and preliminary findings review were conducted and an Acknowledgement of Inspection form was completed and left with the agency.

The Licensing Inspector identified a violation during preparation of preliminary inspection documents that was not discussed during the preliminary findings review. The Licensing Inspector called the Treatment Foster Care Director on 8/3/2022 to discuss, prior to issuance of preliminary inspection documents. An exit interview was conducted by phone on 8/5/2022.

The licensing inspector completed a tour of the physical plant that included the office setting and conditions.

Additional Comments/Discussion:
The Licensing Inspector called the Treatment Foster Care Director on 8/3/2022 to communicate a violation identified during drafting of documents. The violation was not communicated correctly during the preliminary findings review.

The evidence gathered during the inspection determined non-compliance with applicable standard(s) or law, and violation(s) were documented on the violation notice issued to the facility. The licensee has the opportunity to submit a plan of correction to indicate how the cited violation(s) will be addressed in order to return the facility to compliance and maintain future compliance with applicable standard(s) or law.

If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview.

Compliance with all applicable regulations and law shall be maintained and any areas of noncompliance must be corrected.

Within 15 calendar days of your receipt of the inspection findings (inspection summary, violation notice, and supplemental information), you may request a review and discussion of these findings with the inspector's immediate supervisor. To make a request for review and discussion, you must contact the licensing supervisor at the regional licensing office that serves your geographical area.

Regardless of whether a supervisory review has been requested, the results of the inspection will be posted to the DSS public website within 5 business days of your receipt of the Inspection Summary and/ or Violation Notice.

The department's inspection findings are subject to public disclosure.

Description: Violation:

Based on record review, the agency failed to contact Child 2 (C2), a child placed in treatment foster care, as required.

Findings:
1. The case record for C2 documented the child was placed in treatment foster care.
2. The case record for C2 did not include documentation that two (2) face-to-face contacts were conducted in March 2022.
3. The case record for C2 did not document a private interview with C2 in March 2022.
4. The findings were discussed during the preliminary findings review and Staff 2 and 3 (S2 and S3) reviewed the case record and acknowledged the findings.
5. The findings were discussed during the exit interview and staff acknowledged the findings.

Standard #: 22VAC40-191-40-D-4-a
Description: Violation:

Based on record review and interview, the agency failed to obtain background checks for Household Member 1 (HH1) within 30 days of HH1 beginning to reside in the home of Provider 1 (P1).

Findings:
1. The case record for P1 included a contact note documenting a home visit was conducted with P1 on 5/12/2022.
2. The contact note documented, HH1, was in the home during the home visit.
3. The contact note documented the caseworker ??asked how long he [HH1] had been there since the end of April.? [sic]
4. The case record included a Sworn Disclosure Statement for HH1 dated 5/16/2022.
5. The case record included a criminal history search results letter dated 7/11/2022.
6. The findings were discussed during the preliminary findings review.
7. Staff 4 (S4) was interviewed. S4 indicated the foster parents in P1 reported that HH1 was staying in the home sometimes but was staying outside the home on weekends and on weekdays. S4 stated the agency became unclear about the number of days HH1 was staying in the home and made the decision to proceed with background checks in May 2022.
8. The criminal history search results letter was dated 56 days following the date HH1 began residing in the home.
9. The findings were reviewed during the exit interview and staff acknowledged the findings.
