Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

An announced mandated monitoring inspection was initiated on September 28, 2020 and concluded on October 15, 2020. The Program Director was contacted by telephone to initiate the inspection. The agency reports eight (8) foster children in placement and eight (8) approved provider homes. There was one new staff hire since the last inspection. The inspector emailed the Program Director a list of items required to complete the inspection. The inspector reviewed three (3) provider home records, two (2) foster child records, and one (1) personnel records. An exit interview to discuss findings was held with Program Manager by phone at the conclusion of the inspection.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and violations were documented on the violation notice.

The licensee has five (5) calendar days from receipt of the inspection documentation to complete the section titled Plan of Correction, sign each page of the documentation and return it to the Licensing Office. The plan of correction should include the following: The steps to correct noncompliance with the standard(s); measures to prevent re-occurrence of noncompliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected.

The licensee should retain a copy to be posted at the facility. Results of the inspection documentation are subject to public disclosure and will be posted on the VDSS web site within 5 days, regardless of whether the Plan of Correction is completed.

Violations:
Standard #: 22VAC40-131-180-J
Description: Violation:
Based on a review of the background checks for a provider (P1) from provider home 1 (PH1) and interview with personnel (S1), a component of the home study was not documented in the file of the applicant.

Evidence:
1. A national criminal background check for P1 from PH1 dated 11/08/2019 was returned with an ?unable to determine? disposition from the Office of Background Investigation (OBI).
2. On 10/20/2020, in response to the exit interview, S2 provided a Virginia Criminal Record Check dated 10/21/2019. The check listed the date, jurisdiction, charge, and disposition of charges for P1 from PH1.
3. During an interview with S1, she stated that the disposition information is housed in the human resource department of the agency. S1 stated that she is able to view the Virginia Criminal Record but it is not kept in the applicant file at the location where the licensee is approved as required by 22VAC40-131-180.J.

Plan of Correction: BG check dispositional information for foster parents will be maintained in fp files moving forward.

Description: Violation:
Based on a review of the sworn disclosure statement or affirmation for a provider (P1) from provider home 1 (PH1) and interview with personnel (S1), the home study documented in the file did not include a required component.

Evidence:
1. The record for a provider home 1 (PH1) contained a sworn statement or affirmation for provider 1 (P1) dated 10/02/2019 that was not in compliance (22VAC40-131-180-J.1.a).
2. 22VAC40-191-20.D.1. states, ?The sworn statement or affirmation is a written document in which a person must disclose any criminal conviction and any pending criminal charges within or outside of Virginia.?
3. A national criminal background check for P1 from PH1 dated 11/08/2019 was returned with an ?unable to determine? disposition.
4. A subsequent addendum completed by the licensee on 01/13/2020 documented an interview with P1 from PH1, who acknowledged prior convictions in the State of Virginia.
5. On the sworn statement or affirmation for P1 from PH1 dated 10/02/2019, P1 responded ?no? to question #1 which states, ?Have you ever been convicted of or are you the subject of pending charges of any crime within the Commonwealth of Virginia??
6. During an interview, S1 acknowledged that P1 from PH1 did not submit an accurate sworn statement or affirmation.

Plan of Correction: Sworn Statements will continue to be completed for all foster parents, adult household members, etc. for BG checks. If one is completed incorrectly (BG comes back with additional information) a new sworn statement will be completed and filed.
